McDonald’s has failed to prove the genuine use of this trademark for some goods which are coffee, tea, desserts, biscuits, chocolate, non-alcoholic drinks and syrups except chicken nuggets and sandwiches.
McDonald’s has several trademarks containing prefix ‘’Mc’’ all around the world. However, the EUIPO (The European Union Intellectual Property Office) ruled that McDonald’s has failed to prove the genuine use of this trademark for some goods which are coffee, tea, desserts, biscuits, chocolate, non-alcoholic drinks and syrups except chicken nuggets and sandwiches.
Therefore, after losing the trademark ‘’Big Mac’’, McDonald’s has lost its ‘’Mc’’ trademark for certain goods. This also means a second victory (partial) for Supermac's which is the owner of more than 100 fast food restaurants in Ireland.
This decision after ‘’Big Mac’’ decision of the EUIPO has again showed that proving the use of trademarks has a crucial importance for the trademark owners and it stands as a serious threat for the trademark registrations, especially, trademarks which are not in use.
