In 2017, the cancellation action based on non-use has been instituted by Irish fast food company Supermac’s against the BIG MAC trademark of McDonald’s and the European Union Intellectual Property Office has ruled that even though McDonald’s submit evidence regarding the use of BIG MAC trademark; the genuine use of BIG MAC trademark for "restaurant services" and "burgers" could not be proven. As a result, the European Union Intellectual Property Office cancelled the BIG MAC trademark and thus, it is remarkable that the trademark BIG MAC is now open for every company to be used in the EU. However, it should be noted that McDonald’s has a right to appeal the decision.
